Welcome to Cloth. These Terms of Service ("Terms") govern your access to and use of our 3D mockup generation platform, services, and website (collectively, the "Services"). By accessing or using Cloth, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not access or use our Services.

1. Account Registration and Security

1.1 Account Creation

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts

1.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You may not share your account with others or allow others to access your account.

2. Subscription Plans and Billing

2.1 Plan Types

We offer multiple subscription plans:

• Free Plan: Limited features with watermarks
• PRO Monthly: Monthly subscription with full access
• PRO Annual: Annual subscription with 25% discount
• PRO Lifetime: One-time payment for lifetime access

2.2 Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method:

• Monthly subscriptions are billed monthly on the date you subscribe
• Annual subscriptions are billed yearly on the anniversary of your subscription
• Lifetime subscriptions are charged once at the time of purchase
• All prices are in USD and subject to change with 30 days notice

2.3 Automatic Renewal

Monthly and Annual subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

2.4 Cancellation

You may cancel your subscription at any time from your billing settings:

• Cancellation takes effect at the end of your current billing period
• You will retain access to premium features until the end of your billing period
• No partial refunds are provided for unused time
• After cancellation, your account will revert to the Free plan

2.5 Refund Policy

If a payment fails, we will attempt to charge your payment method again. If payment cannot be processed after multiple attempts, your subscription may be suspended or canceled, and your access to premium features will be revoked.

3. Acceptable Use

3.1 Permitted Use

You may use our Services to:

• Create 3D mockups for personal or commercial projects
• Upload your own designs, images, and textures
• Export and use the mockups you create
• Share and showcase your work

3.2 Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble our software
• Use automated tools to scrape or download content
• Share your account credentials with others
• Resell or redistribute our Services without permission
• Upload content that is illegal, offensive, or violates others' rights
• Abuse our support or create excessive load on our servers

4. Intellectual Property Rights

4.1 Your Content

You retain all rights to the content you upload and create using our Services. By uploading content, you grant us a limited license to:

• Store and process your content to provide the Services
• Create backups for reliability and disaster recovery
• Display your content back to you in the platform

You represent that you have all necessary rights to the content you upload and that your content does not infringe on third-party rights.

4.2 Our Platform

Cloth and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software or platform
• Remove any copyright or proprietary notices
• Use our trademarks without permission

4.3 Exported Mockups

Mockups you create and export are yours to use commercially. Free plan exports include watermarks; PRO plan exports are watermark-free. You may use exported mockups in any way that complies with applicable laws.

5. Content Monitoring and Removal

We reserve the right to:

• Monitor content uploaded to our platform
• Remove content that violates these Terms or applicable laws
• Suspend or terminate accounts that violate our policies
• Report illegal content to authorities

We do not pre-screen content but reserve the right to review and remove content at our discretion.

6. Service Availability and Modifications

6.1 Availability

We strive to provide reliable Services, but we cannot guarantee:

• Uninterrupted or error-free operation
• 100% uptime (maintenance and updates may occur)
• That all features will work on all devices or browsers

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We will provide reasonable notice for material changes that negatively affect your use of the Services.

Upon termination, your data will be deleted within 90 days, except as required by law.

We may suspend or terminate your account immediately if:

• Your account is used for illegal activities
• You fail to pay subscription fees
• We are required to do so by law

Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cloth regarding your use of the Services.
